Yes, people experiencing homelessness often go to jail, not directly for being homeless, but for laws that criminalize survival activities (like sleeping, camping, begging) or for minor offenses linked to poverty, such as trespassing or public nuisance, creating a cycle where homelessness leads to jail, and jail exacerbates homelessness. Some individuals even choose jail for shelter, food, and safety.
Being Homeless in New South Wales
Thankfully, New South Wales, alongside Western Australia and the ACT, is one of the few states that doesn't actively fine people for being homeless. However, there are still a large number of laws and regulations that disproportionately punish the State's homeless.
Step 4: Decision after 56 days
If we are unable to solve your homelessness by the end of 56 days, we will then make a decision about whether we owe you the "Main Housing Duty". For this, you need to be able to prove you pass five tests.

Protect Your Belongings and Identity
Keeping your essential items safe is a key part of surviving homelessness. Start with what's most important: your ID, passport, birth certificate, and social security card. You will need these to maintain access to shelters, healthcare, jobs, and housing programs.
(1) A person must not beg or gather alms. Penalty: 12 months imprisonment. (2) A person must not cause, procure or encourage a child to beg or gather alms.

Make It Clear That You Will Call the Police

Ask a homeless continuing care program provider for help. They can help you find temporary or permanent housing. Contact your local public housing agency (PHA) for help moving from homelessness to more permanent housing.

Through out the 56 days, the Council has a duty to work with you to take reasonable steps to secure accommodation. After the 56 days the Council may be satisfied that they have done everything it can to help you find accommodation.
