Yes, the government can see your texts, but usually requires a warrant for content (like with a subpoena or court order for non-encrypted messages) or through sophisticated spyware/physical access, though metadata (who, when, where) is often collected more broadly, especially from international communications, and flagged for review, with platforms like WhatsApp using end-to-end encryption for message content.
Spyware and monitoring apps need elevated permissions to access your SMS messages. You can check whether any apps have permission to see your SMS messages by going to the Permission manager in your Android settings. To check and disable SMS permissions on an Android device: Open Settings > Privacy > Permission manager.
SMS is inherently unencrypted, unlike modern messaging apps such as WhatsApp, Signal, or iMessage, which use end-to-end encryption (E2EE) to secure conversations. This means that messages sent via SMS can be viewed, stored, and even intercepted at multiple points along their journey from sender to recipient.
In many cases, the police are still able to download text messages from your phone, even when you have deleted them. If the police cannot obtain data from your phone, they might try to get the data from your mobile phone service provider instead.
We do not retain data for law enforcement purposes unless we receive a valid preservation request before a user has deleted that content from our service. In the ordinary course of providing our service, WhatsApp does not store messages once they are delivered or transaction logs of such delivered messages.
Many people believe their messages are private, especially if they use encrypted apps or “disappearing” messages. The truth is more complicated. Federal investigators can — and frequently do — obtain text messages and DMs sent by people involved in federal cases.
WhatsApp messages are end-to-end encrypted which means that only the sender and receiver can read the contents of the message. Nobody can intercept the message and read the contents – not even WhatsApp or the police. That said, the police can access your WhatsApp (including messages and other data) using other means.
You can retrieve permanently deleted texts from a backup if you have an automatic backup option enabled, or if you have manually performed one before you deleted your texts. If a backup of your Android device is available, installing this should restore any messages you deleted before the backup was saved.
Digital forensics can uncover messages long after they were sent or deleted, especially if stored in backups.
Deleted Messages Aren't Always Gone
Legal teams can subpoena those backups if needed. Courts can also approve forensic analysis to recover deleted texts from phones, especially in criminal or civil cases involving fraud or harassment. So texting something and then trying to erase it rarely protects you.
WhatsApp offers more security than text messaging by using end-to-end encryption, which ensures only the sender and receiver can read the messages. But neither option is immune to smishing scams, designed to steal your personal information or get you to click malicious links.
Examples of risky texts include:
One prevalent threat is SMS phishing, wherein malicious actors attempt to deceive users into divulging sensitive information by posing as a trusted entity. Additionally, SMS interception, often caused by weaknesses in network protocols, poses a significant risk to the security of text messages.
Here are the most common warning signs that your phone is being mirrored, tracked, tapped, or monitored by spyware software:
If you get malware on your iPhone or Android device, does a factory reset remove it? The short answer is that it can and will in most cases, but there are some things to consider first. Once you do a factory reset, it's an irreversible act.
Here, I use the Samsung Galaxy S20+ as an example to show you how to hide SMS on Android by locking the Messages app:
Manually delete text messages from Android phone:
Yes, you can go to your carrier company. All messages are stored up to a year in your account. They can pull any messenger or photo that's been sent. If you have an IPhone, go to messages, click on filters and recently deleted messages.
Note: When you delete a chat, it can't be undone. WhatsApp is unable to recover deleted chats for you. You can only recover deleted chats if your latest backup occurred prior to deleting a chat. Please be aware that you'll lose any chats that occurred after the latest backup.
If it was "regular" texts, there is a possibility the carrier retains copies of messages in phone records for a period of time. Or if you have a backup of your phone before they were removed.
In reality, most U.S. carriers do not retain message content for long, if at all. However, they do keep metadata—information about when and to whom messages were sent or received.
The only reliable way to retrieve deleted messages on Android is to access the backup file using Google Drive. To access the file and read the messages, go into the Google Drive associated with your husband's account on a computer. Scan the backup folder for the date you want to take a look at and open it.
Message privately. Your privacy is our priority. With end-to-end encryption on WhatsApp, your personal messages, photos, calls and more stay between you and the people you choose, meaning not even WhatsApp can see them.
To check if someone has access to your WhatsApp account via WhatsApp Web, open WhatsApp on your phone, go to the menu (the three vertical dots), then select "Linked devices". You will see a list of all active sessions. If you notice a session you don't recognize, you can disconnect it immediately.
In civil claims, parties sometimes rely on WhatsApp chats to prove that informal agreements or contracts were made. Even casual messages can be binding if they demonstrate agreement between the parties.
