Child support is usually paid until a child turns 18. Some situations where it may be stopped early include: if the child becomes self-sufficient. if the child marries or enters into a defacto or marriage like relationship.

Normally child support stops when your child turns 18. If your child's in secondary study, you can apply to extend it to the end of the school year.
If you don't pay your child support in full and on time, we may apply penalties on the outstanding amount. You pay the penalty amount to the Australian Government, not to the receiving parent. If you pay the overdue child support, we may reduce or remove the penalty from your account.
Liability order from a court
CMS can take you to court over unpaid child maintenance. They can apply for a court order to take legal action. This is a 'liability order'. If the court grants the order, CMS can then legal action against you.
Some people do not have to pay child maintenance
You will not be expected to pay anything through the Child Maintenance Service if you: Share care equally with the other parent. Are in full-time education with no income.
The fixed rate for child support periods starting on or after 1 January 2022 is $1,521 per child per year. If you pay the fixed rate for more than 3 children, we'll cap the amount at 3 times the fixed rate. If you pay the fixed rate to more than one person, we divide the amount between those receiving parents.

So, if a child finishes their A-levels/college education at age 18, the paying parent only needs to pay child maintenance until they finish, because university education does not fall under the umbrella of secondary education.
How long do I have to pay child maintenance for? Child maintenance payments usually stop when children reach the age of 16. However, if the child is in full-time approved education, it may stay in place until they reach the age of 20.
Centrelink may also require parents to apply for an assessment of child support payable by the other parent. A person who starts a de facto relationship with a person who already has children does not have a legal obligation to support those children except in special circumstances.
Can I get more child support if my ex remarries? No. Only the income of the mother and the father of your children is taken into account. So, even if your ex marries a millionaire, their income won't change your child support.
If you're the child's parent, you have to pay maintenance even if you don't see them. Paying maintenance doesn't mean you have a right to see the child. If you'd like to see them, you should first try to agree with the person who's looking after them.
Exempt Income
a personal allowance for single people over the age of 25 years. an allowance for a child living with the parent (their own child) if there is such a child, a family premium. a disabled premium for any qualifying child or parent.
Child maintenance payments
If shared care happens for an average of one night a week or more (at least 52 nights a year), this can affect the amount of child maintenance. The more nights that the child stays overnight with the paying parent the less child maintenance is due.
In Australia shared custody means that the non-residential parent pays child support to the residential parent. In the case of a 50/50 split, the higher earner usually pays child support to the lower earner to ensure the children's standard of living is the same in both locations.
On the basic rate, if you're paying for: one child, you'll pay 12% of your gross weekly income. two children, you'll pay 16% of your gross weekly income. three or more children, you'll pay 19% of your gross weekly income.
For the 2021-22 financial year, it's a payment of up to $788.40 for each eligible child. For the 2022-23 financial year, it's a payment of up to $817.60 for each eligible child.
Child support scheme
Under Australian law, separated parents (including same sex parents) have a duty to provide a proper level of financial support for their children. The scheme provides a flexible way of ensuring that children are supported by their parents, often with the assistance of government benefits.
They must first sue you, win the lawsuit, and get the court to issue a wage garnishment order against you. Once they jump through all of these hoops, the amount they can garnish is limited to a maximum of 25% of your disposable income. We work out each parent's income percentage by dividing each income by the combined total. We calculate each parent's percentage of care. We work out each parent's cost percentage using the Care and Cost table. We subtract the cost percentage from the income percentage for each parent.
According to the Maintenance Act, non-compliance with a maintenance order is a criminal offence unless the reason for non-payment is due to a lack of means. The Act describes various ways to enforce maintenance orders when an ex-spouse is refusing to pay and to force them to pay the defaulted amount.
The parent paying Child Maintenance will normally be expected to continue to pay Child Maintenance until the child reaches 16 years old or 20 years old if they are in approved full-time non-advanced education or training.
If your ex-partner stops paying, thereby breaching the Order, you can apply to court to enforce it. If you did not get a Consent Order, your voluntary agreement is not legally binding. You can try to negotiate with your ex-partner to try and resume the payments.
Whether or not you have remarried, or your ex-partner has remarried, does not affect the obligation to continue paying child maintenance. However, when the child maintenance service assesses the level of child maintenance payments, the amount of the payments can be varied if you have additional dependents to support.
